Terms & Conditions (SaaS Agreement)

Last Updated: 16 October 2026

Version: v1.0

Welcome to Creveto Pro (operated by [Legal Entity Name]). By registering, accessing, or using our QR generation, product authentication, and inventory management SaaS platform (the "Service"), the business entity ("Tenant", "Brand", or "you") agrees to be bound by these Terms and Conditions, along with our Privacy Policy, Acceptable Use Policy (AUP), and Data Processing Addendum (DPA).

1. Service Description & Tenant Responsibility

Creveto Pro provides a B2B technology platform for generating tracking QR codes, supply chain analytics, and product verification. You agree to use this Service only for lawful business purposes. You are solely responsible for the accuracy, legality, intellectual property rights, and quality of the physical products, batch numbers, and brand assets you upload to our system. Creveto Pro does not inspect, manufacture, store, or warrant any physical products.

2. Prohibited Activities & Acceptable Use

In accordance with our Acceptable Use Policy (AUP), to maintain the integrity of our ecosystem, you must NOT:

  • Use our platform to generate QR codes for illegal, counterfeit, stolen, smuggled, banned, or expired products.
  • Claim brand ownership, certifications, or trademarks that you do not legally hold.
  • Attempt to manipulate, bypass, scrape, reverse engineer, or launch automated attacks against our scan tracking and multi-tenant architecture.
  • Exceed your allocated storage (MB/GB) or QR generation quota without upgrading your subscription plan.

3. Data Processing, Privacy & Retention

Under the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Tenant acts as the Data Fiduciary and Creveto Pro acts as the Data Processor for End-User scan data, as detailed in our DPA. End-User scan logs (IP address, location, device metadata) are retained for a maximum of 12 months for financial and security audits and are automatically deleted/anonymised thereafter. Product batch labels automatically transition to an "Expired" status upon passing their configured expiry date.

4. Account Suspension, Non-Payment & Termination

We reserve the absolute right to immediately suspend, disable QR codes, or terminate any Tenant account without prior notice or refund if we detect suspicious activity, counterfeit operations, or any violation of these Terms or the AUP. In the event of non-payment or account termination, account access is locked immediately, and associated data will be permanently deleted after 30 days unless retention is required by law.

5. Payment, Taxes & Refund Policy

Our platform operates on an advance subscription and usage basis plus applicable Indian GST. All payments are governed by our Refund & Cancellation Policy. Except for specific exceptional circumstances explicitly outlined in the Refund Policy (such as duplicate technical charges), subscription fees, consumed QR quotas, and setup charges are non-refundable.

6. Indemnification

The Tenant agrees to indemnify, defend, and hold harmless Creveto Pro ([Legal Entity Name]), its founders, officers, and affiliates from and against any and all third-party claims, regulatory penalties, damages, losses, or legal fees arising out of: (a) the Tenant's distribution of counterfeit, defective, or unlawful goods; (b) violation of intellectual property rights; or (c) failure to comply with applicable consumer protection or data privacy laws.

7. Limitation of Liability (Liability Cap)

The Service is provided on an "as-is" and "as-available" basis (target uptime governed by our SLA Policy). Creveto Pro shall not be held liable for any indirect, incidental, special, or consequential business losses, loss of profits, or reputational damage arising from reliance on scan verification results, approximate geolocation data, or third-party outages. To the fullest extent permitted by law, Creveto Pro's total cumulative liability for any and all claims under this Agreement shall not exceed the total subscription fees paid by the Tenant to Creveto Pro in the three (3) months immediately preceding the event giving rise to the claim.

8. Modifications & Version Control

We may update these Terms occasionally. Material changes will be notified via email or dashboard alerts with an updated version number and date. Continued use of the platform after modifications constitutes your acceptance of the updated Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the DPDP Act, 2023. Any legal disputes or proceedings arising out of this Agreement shall be subject to the exclusive jurisdiction of the competent courts at Raipur, Chhattisgarh, India.
